1. Acceptance of Terms

By accessing or using MapX ("Service," "App," "we," "us," or "our"), you agree to comply with and be bound by these Terms of Service and End User License Agreement ("Terms," "EULA"). These Terms apply to all users of the App, including without limitation users who are browsers, customers, and contributors of content.

2. Description of Service

MapX is a location-sharing application that allows users to:

• Share real-time location with selected group members
• Create and manage private groups using unique 6-digit codes
• View battery status and network connection of group members
• Set privacy controls and temporary location hiding
• Communicate with group members through the platform

4. Eligibility

To use MapX, you must:

• Be at least 13 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information
• Maintain the security of your account credentials

5. User Account

5.1 Account Creation

You must create an account to use MapX. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

5.2 Account Termination

You may terminate your account at any time through the app settings. We reserve the right to suspend or terminate accounts that violate these Terms.

6. Acceptable Use Policy

You specifically agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Track or monitor individuals without their explicit consent
• Harass, abuse, stalk, or harm other users
• Impersonate any person or entity
• Share false or misleading location information
• Attempt to gain unauthorized access to other accounts
• Use the Service to violate anyone's privacy rights
• Reverse engineer or attempt to extract source code
• Use automated systems or bots to access the Service
• Transmit viruses, malware, or harmful code
• Violate any applicable laws or regulations

7. Privacy and Location Sharing

7.1 Consent to Location Sharing

By joining a group, you explicitly consent to share your location with all members of that group. You understand that:

• Your real-time location will be visible to group members
• Your battery status and network type will be displayed
• You can leave a group or hide your location at any time
• Group members can see when you were last active

7.2 Responsible Sharing

You are responsible for:

• Only joining groups with people you trust
• Not sharing group codes with unauthorized individuals
• Respecting the privacy of other group members
• Using the Service in accordance with all privacy laws

8. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of SECKIN SEFA DURASI and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

9. User Content

By uploading content to MapX (such as profile photos), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with providing the Service. You represent that you have all necessary rights to grant this license.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of location data
• Uninterrupted or error-free service
• Security of transmitted data
• Accuracy of third-party map services

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MAPX, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Unauthorized access to or alteration of your transmissions or data
• Statements or conduct of any third party on the Service
• Any damages exceeding the amount paid by you to use the Service

12. Emergency Situations

The App should not be relied upon as your sole means of communication or location sharing in emergency situations. Always have alternative methods of communication available.

13. Indemnification

You agree to defend, indemnify, and hold harmless MapX and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.

14. Third-Party Services

MapX may contain links to or integrate with third-party services (such as Apple Maps or OpenStreetMap). We are not responsible for the content, privacy policies, or practices of these third-party services. Your use of such services is governed by their respective terms and policies.

15. Modifications to Service

We reserve the right to:

• Modify or discontinue the Service at any time
• Change features, functionality, or pricing
• Impose limits on certain features or restrict access
• Terminate the Service with or without notice

16. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you through the App or by email. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Istanbul, Turkey.

18. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiations. If such negotiations fail, disputes shall be resolved through binding arbitration in accordance with the rules of the Turkish Arbitration Association.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MapX regarding the use of the Service and supersede any prior agreements between you and us relating to the subject matter.
