Terms of Use

1. Agreement to Terms

By downloading, installing, or using MasterDock ("the App", "the Service", or "the Software"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of these terms, then you may not access or use the Service.

This End User License Agreement ("Agreement") is a legal agreement between you and Seçkin Sefa Durası ("Developer", "we", "us", or "our") for the MasterDock software application.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and use the App for your personal, non-commercial purposes on any macOS device that you own or control
• Access and use the features included in your subscription level
• Create and save custom dock configurations for personal use

License Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, disassemble, decompile, or decode the App
• Sell, rent, lease, sublicense, distribute, or transfer the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Share your subscription or account with others

3. Subscriptions and Payments

3.1 Subscription Plans

3.2 Payment Terms

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• The renewal cost will be the same as the original subscription price unless we notify you of a price change
• Subscriptions may be managed and auto-renewal may be turned off in your Apple ID Account Settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

3.3 Free Trial

If we offer a free trial period, you may cancel your subscription at any time during the free trial period through your Apple ID account settings without being charged. If you do not cancel before the free trial ends, you will be automatically charged the subscription price.

4. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Seçkin Sefa Durası and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

User Content

You retain ownership of any custom configurations or settings you create within MasterDock. However, you grant us a license to use this content solely for the purpose of providing the Service to you.

5. Privacy Policy

Your use of our Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

6. Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination:

• Your right to use the Service will cease immediately
• You must delete all copies of the App from your devices
• All provisions of the Terms which should reasonably survive termination shall survive

7. Disclaimers and Limitations of Liability

7.1 No Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

7.2 Limitation of Liability

IN NO EVENT SHALL SEÇKIN SEFA DURASI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

7.3 System Requirements

MasterDock requires macOS 13.0 (Ventura) or later. We are not responsible for any issues arising from using the App on unsupported systems or configurations.

8. Indemnification

You agree to defend, indemnify, and hold harmless Seçkin Sefa Durası and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

9. Updates and Modifications

9.1 App Updates

We may from time to time provide enhancements or improvements to the features/functionality of the App, which may include patches, bug fixes, updates, upgrades, and other modifications ("Updates"). Updates may modify or delete certain features and/or functionalities of the App.

9.2 Terms Updates

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

10. Refund Policy

All purchases are final and processed through Apple's App Store. Refund requests should be directed to Apple Support according to their refund policy. We do not have the ability to issue refunds directly.

11. Export Compliance

You may not use or otherwise export or re-export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained. In particular, but without limitation, the App may not be exported or re-exported into any U.S. embargoed countries or to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce Denied Person's List or Entity List.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Dispute Resolution

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration, using the English language in accordance with the Arbitration Rules and Procedures of the American Arbitration Association.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15. Entire Agreement

These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
